I am attaching a copy of the Guam Code Annotated Chapter on Cockfighting. It contains the applicable laws but there are other issues which have to be considered by anyone who is interested in this kind of business.
First of all, the laws call for the appointment of a Board – consisting of three members – who are responsible for the enforcement of the law, development of regulations and procedures, adjudication of all appeals and grievances between cockfighters, and the licensure of referees.
The Board also is responsible for the announcement, receipt, evaluation and award of bids for the three authorized licenses for either amara or ballentia pits. Presently there are three pits that are authorized – although I understand that all of the previous licenses have expired and there have been no new licenses issued because there is no board. The pits are authorized for the North (Dededo or Yigo) Central (Tamuning, Barrigada, Mangilao or Hagatna, and South, Agat, Malesso, Inarajan, Yona. To date, there is only one pit operating – the Dededo pit which is operated by former Senator Eddie Charfauros.
The Governor is authorized to issue temporary permits to the Municipal Planning Council of each village for the village fiestas as a means of raising funds for the village programs. However, this has been convoluted and now these MPCs are operating pits for weeks at a time, not only during the three day fiesta period. This makes it very difficult for legal pits to operate and compete with these village pits. The village pits are now even staging derbies when the original intent of permitting fiesta fights was for open (non-derby) matches.
I attempted to bid on a license at one time – the expiring license for Central Guam – to take over the Sport O Dome of Art Toves when he shut it down but was out bidded by Johnny Reyes who bid $327,000 to my $325,000 for a five year license.
Eddie’s idea of having ballentia fights (not Amara) no knives and non-lethal, may have difficulties getting the present day fighters interested. Some individuals tried to open a ballentia pit in Yigo a while back and there very little interest – the individual fights are long and drawn out and people get bored very quickly.
I hope a copy of the law helps but I would suggest that these investors talk first to the cockfighters to ascertain their feelings and opinions.
